ZONING BOARD OF ADJUSTMENT

MINUTES OF THE MEETING HELD May 5, 2008

MEETING CONVENED AT 7:10 PM

 

Members Attending: Beverly Power, Fred Ward, Nancy Robinson, Sandy Sherman and Ruth Ward, Alternate.

Excused was Richard Betz

 

Correspondence:  New Land Use Manuals; Shoreland Protection Act Updates; Copy of Shoreland Waiver for John & Allison Palmer, Municipalis Newsletter on Variances, etc.

 

Minutes of previous meeting:  Sandy Sherman moved and Fred Ward seconded to accept the minutes of the September 17, 2007 meeting as presented, the board approved.

 

Old Business: as built pictures for Dougeneck and Jonathan Tuthill have not been taken but Fred Ward will follow up at his earliest convenience and include Wesley Warren at the same time.

 

New Business: New Shoreland Protection Act Regulations were passed out and Beverly Power brought the board up to date on a workshop she and Fred Ward attended on the subject.  Each member was given a copy of the new regulations.  Beverly Power pointed out several changes that will affect the deliberations of the board in future variance hearings.

 

Application for Variance: 7:15 PM Public Hearing was held on an Application by Emil & Jo Ann Kaczka, Jr. to allow construction of a carport closer than 25 feet from the lot line.  After a site visit Beverly Power suggested placing the carport (boat port) in the circle inside the right of way driveway.  Fred Ward said he is concerned on the quality of run off once the structure is installed.  The public hearing was closed at 7:35 PM.  The board completed the Finding of Facts forms.  The secretary tallied the forms and announced the application was denied.  The board members felt that there is ample area in which to construct the carport (boat port) outside the allowable setbacks.

 

Application for Special Exception: None

 

Application for Site Plan Review: None

 

Adjourned:  Fred Ward moved and Ruth Ward seconded to adjourn at 8:06 PM, the board approved.
