TOWN OF STODDARD

ZONING BOARD OF ADJUSTMENT

MINUTES OF THE MEETING HELD June 30, 2010

MEETING CONVENED AT 7:00

 

Members Attending: Beverly Power, Richard Betz, Fred Ward and Ruth Ward.  Absent was Maureen Meyer

 

Correspondence:  copies of updated checklist for applications and new section 3 of application for a variance

 

Minutes of previous meeting:  Richard Betz moved and Ruth Ward seconded to accept the minutes of the February 20, 2010 meeting as presented, the board approved.

 

Old Business:  None

 

New Business: Beverly Power moved and Fred Ward seconded to reappoint Richard Betz to the Zoning Board of Adjustment for a 3-year term, the board approved.

 

Application for Variance: 6:30 PM met at the site to review the markers and affirmed the distance from the side lot line at 15'.  7:10 Public Hearing on request of Jennifer and Scott Tucker for a Variance from Community Planning Ordinance Article 111, Section 1 to construct a deck with less than 25' of setback from the property line.  Beverly Power opened the public hearing and informed the applicants that the board was not complete and asked if they would accept the verdict of the board of 4.  She explained that it is easier to receive 3 affirmative votes in a 5-member board.  The Tuckers agreed to accept the verdict of the 4 members present.   Beverly Power asked what the supports for the deck would be made of.  Mr. Tucker said concrete footings with environmentally safe, pressure treated timbers encased in Trex.  The board reviewed the NH DES Shoreland Impact Permit 2010-0087 for conditions set in their approval of the application.  It was discovered that the conditions call for granite posts to support the deck.  The Public Hearing was closed at 7:20 PM.

The board addressed the finding of facts forms.  The secretary tallied the forms and announced that the variance was approved.

 

The following conditions were imposed in the approval:

1.  The approval is given to mirror the conditions imposed by the State of New Hampshire Department of Environmental Services. 

2.  Impact 140 sq. ft. for the purpose of constructing a 10' X 14' deck with granite steps, granite posts and landscaping.

 

The Tuckers were advised that the Selectmen will not be meeting on July 5, 2010 and the approval will be submitted to them for building permit approval at the July 12, 2010 meeting.

 

 

Application for Special Exception:  None

 

Adjourned:  Fred Ward moved and Ruth Ward Seconded to adjourn at 7:24 PM, the board agreed.

NOTICE OF DECISION

 

Case 2010#2

 

Dear  Jennifer & Scott Tucker:

 

You are hereby notified that the appeal of  Jennifer and Scott Tucker for a variance regarding Article 111, Section 1 of the Community Planning Ordinance, to construct a deck within the 25' of setback from the west side property line, has been GRANTED, by the affirmative vote of at least three members of the Zoning Board of Adjustment.  It is further noted that granting this variance is contingent upon the applicant(s) obtaining all required permits.

 

Conditions set for awarding this variance are:

 

1.  The approval is given to mirror the conditions imposed by the State of New Hampshire Department of Environmental Services.
