Meeting Minutes October 20, 2022

 

The Chairperson called the meeting to order at 7:30 pm

Pledge of Allegiance was led by the Chairperson

Roll Call: Jason Kovarik, Milsoh Bukovcan sitting in for Bud, Herb Healy, Doug Summerton

Members Excused: Bud Record, Franz Haase

Others present:  Harry Power Compliance Officer

Meeting Minutes

  • September 15, 2022 minutes approved unanimously.  Suggestion was made to put the words Preliminary and Approved in the document title on the town webpage, so people won’t be confused.

Old Business

  • Will continue discussion of Wetlands Ordinance in the CPO at another time.  Herb is waiting to hear back from legal counsel regarding clarification on the procedures that involve the ZBA in the CPO.
  • Compliance officer has no new concerns for the ZBA.

New Business

  • Herb presented a draft of our ZBA Rules of Procedure to include the changes in NH laws, HB1661 & RSA 676.7.
  • The changes are to Applications/Decisions and Public Hearing section of our procedures, along with a line added to Deliberations and Decisions (b, iv).
  • New state law requires ZBAs to hold a hearing within forty-five (45) days of receipt of an application for zoning relief, and begin formal consideration and to approve or disapprove the application within 90 days of the date of receipt. If additional time is needed to make a decision, an extension can be granted by mutual decision between the ZBA and Applicant. If an applicant will not give the ZBA extra time (extension), the application is denied w/o prejudice and the applicant can reapply.
  • Doug asked if applicant does re-apply, would he/she need to send in another check? He suggested dropping the application fee in this situation. Discussion on our current fee structure ensued. Jason suggested we correct the current fee structure, as there is a processing fee but no application fee.  Herb agrees the applicant should pay the cost of the hearing but not another application fee. Members decided to take this up at the November meeting.

Adjournment.  All voted in favor to adjourn the meeting at 8:22 pm.  The next meeting will be on 11/17/22 at 7:30 pm and will be held at the Stoddard Town Hall.
